Consultations on the Draft CIL Charging Schedule
We're currently carrying out a Draft Community Infrastructure Levy Charging Schedule modifications consultation.
To prepare for submission of the draft Charging Schedule for examination, a review of up-to-date sales values and build costs was commissioned earlier this year which has resulted in further modifications to the Charging Schedule.
The National Planning Policy Guidance (paragraph: 034 Reference ID: 25-034-20190901) clarifies that:
Where any changes are made to a draft charging schedule after publication, the charging authority must set these out in a statement of modifications. Charging authorities should take any steps they consider necessary to inform people who were invited to make representations on the draft charging schedule that this statement has been published.
The Guidance goes on to state that anyone wishing to comment on the modifications may ask to be heard by the examiner within 4 weeks of publication of the statement of modifications.
We are therefore consulting on the statement of modifications and supporting documents for 4 weeks ending on Friday 15 August at 11.59pm. The available documents include:

You can comment on our statement of modifications and supporting documentation by sending your response by email: localplan@york.gov.uk.
Your response should include:
- ‘CIL Statement of Modifications consultation’ in the title
- Your contact details, including your company or agent (if relevant)
- Whether you agree or object to the proposed modifications and why
- Clear reference to the modification number or individual sections of the Viability Study Addendum (June 2025) you are commenting on
- Confirmation whether you wish to participate in the CIL examination, and details of the modification number on which you wish to be heard

Please note: Further comments must be restricted to the statement of modifications and supporting documentation.
Where comments have previously been submitted to our CIL consultations in 2023 or 2024, then these comments will be submitted in full to the Independent Examiner. Therefore, there is no need to repeat the same points again: if they are included in your earlier representations, then they will be taken into account.

CIL Consultation Spring 2023 and representations
Executive in January 2023 agreed to proceed with a public consultation on the CIL draft charging schedule following preparation of the appropriate evidence base. A public consultation was held between February and March 2023 to consult on the relevant documents.
The proposed CIL rates in the Draft Charging Schedule were based on the conclusions of the CIL Viability Study (December 2022).

CIL Consultation on the revised draft Charging Schedule Winter 2023 and representations
A consultation on the CIL draft Charging Schedule took place in Spring 2023. Following the comments received, the Council has undertaken sensitivity testing to test alternatives suggested and whether the charging schedule proposed remained viable. This consultation sets out the revised draft CIL charging schedule following this testing.
