Adoption of Community Infrastructure Levy

We received the Examiner’s Report on the Examination of the City of York’s Community Infrastructure Levy (CIL) Charging Schedule on Wednesday 22 October 2025.

On Thursday 6 November 2025 Council approved and adopted the City of York CIL Charging Schedule. It's anticipated that the Charging Schedule will take effect from 1 February 2026.

Further clarification regarding the proposed instalment policy will be made available imminently.

Any person aggrieved by the CIL Charging Schedule may make an application to the High Court for Judicial Review on grounds that the document is not within the appropriate powers and/or a procedural requirement has not been complied with.

Any such application must be made promptly, and in any event, no later than Thursday 18 December 2025 (6 weeks after the 6 November 2025 adoption date).

Consultations on the Draft CIL Charging Schedule

To prepare for submission of the draft Charging Schedule for examination, the Council undertook public consultation on the relevant documents.

Spring 2023

In January 2023, Executive agreed to proceed with a public consultation on the CIL draft charging schedule following preparation of the appropriate evidence base. A public consultation was held between February and March 2023 to consult on the relevant documents.

The proposed CIL rates in the Draft Charging Schedule were based on the conclusions of the CIL Viability Study (December 2022).

Winter 2023

Following the comments received during the previous consultation, the Council undertook sensitivity testing to test alternatives and whether the charging schedule proposed remained viable. This consultation in December 2023 to January 2024 set out the revised draft CIL charging schedule following this testing.
