Neighbours of short-term and holiday lets and Airbandb properties in York are often concerned about issues including parking, waste, smoking and general safety, but the major concern is about the potential for noise.
Depending on the severity of the noise and its impact, for the first complaint we'll usually write to the owner of the property and advise them that their guests have been causing a noise disturbance to residents, and request that they take steps to ensure that their guests behave in a reasonable manner in the future.
If problems continue it may be necessary to obtain evidence to establish a statutory nuisance so enforcement action can be taken. If sufficient evidence is obtained, a Noise Abatement Notice can be served on the property owner who is responsible for the lets.
If the owner fails to comply with the abatement notice, this can result in prosecution in the Magistrates’ Court with a fine of up to £20,000.
See more information on the guidance we provide to owners of holiday lets in York including our recommendations for property owners managing noise.
