CYC have also provided a response to the Inspectors’ message to the Council (EX/INS/44) in relation to an email sent to them by the York Travellers Trust regarding a Freedom of Information request.

Stantec, on behalf of Barratt and David Wilson Homes, submitted the recent appeal decision for land to the east of New Lane, Huntington to the examination. The Inspectors are currently considering the decision and its implications for the Plan.

Consultation on the two proposed revised Green Belt boundaries at The Retreat and Askham Bryan Agricultural College and a change to the footnote of MM5:21 Policy H10: Affordable Housing has now closed. All comments have been passed onto the Inspectors for consideration.

Following consideration of the responses to the Main Modifications, the Inspectors have highlighted two Green Belt boundaries where there may be issues in relation to consistency of approach. The Inspectors are of the view that the Green Belt boundaries proposed need to be changed for both. The Council has prepared maps showing the proposed revised Green Belt boundaries:

Recognising that these are significant changes, the Inspectors are of the view that there needs to be some consultation on these matters.

Also, the Council brought to the attention of the Inspectors a minor presentational issue within one of the Main Modifications: MM5.21 Policy H10: Affordable Housing.

The modifications to table 5.4 refer the reader to footnote 2 for all sites between 5 and 14 dwellings. That footnote clarifies that the off-site financial contribution (OSFC) is only applicable to sites with a maximum combined floorspace of more than 1,000sqm. For clear consistency with the relevant PPG, the Council would like to recommend that the footnote is amended to include a reference to the floorspace threshold only applying to schemes of 5 to 10 homes.

The Inspectors require any comments on either the proposed Green Belt boundary revisions and/or the proposed amendment to MM5.21 Policy H10: Affordable Housing to be submitted to the Programme Officer by 12 noon Thursday 7 September 2023. Comments on any other matters will not be accepted.

1 August 2023

The Council submitted an amended version of the Main Modifications Responses document: EX/CYC/123a(i).

The only amendment is the removal of the reference to members of the York Travellers Trust in Appendix 2 paragraph 11 (page 19).

29 June 2023

The Council submitted a further amended version of the Main Modifications Reg.22 Addendum - EX/CY/123b(ii). This now supersedes the 2 previous versions. The only amendment to this version is the inclusion of a representation from Heslington Parish Council at the request of the Inspectors, which had previously been identified by the Council as non duly made.

28 June 2023

Following the publication of EX/CYC/123b it was brought to light by consultants that a comment had been omitted. Even though the Inspectors are in receipt of the full representation, for transparency, the Council has sought to rectify this and has submitted an amended report EX/CYC/123b(i). The only amendment to the revised report is a further comment in the summary table in Appendix H to MM3.42 made by Airedon Planning obo Mr Harrison.
