Section 50 Street Works Licence
Any organisation or individual that is not a statutory undertaker must apply for a Licence under Section 50 of New Roads and Street Works Act 1991 (NRSWA) from us if it wants to:
- place, or to retain, apparatus in the street
- carry out any works required for, or incidental to, such works (including, in particular, breaking up or opening the street, or any sewer, drain or tunnel under it, or tunnelling or boring under the street)
The licence is also likely to cover additional activities to inspect, maintain, adjust, repair, alter or renew the apparatus, change its position or remove it.
Those who hold a Section 50 Licence are included in the NRSWA definition of ‘undertaker’.
A licence is required for works on any City of York Council adopted highway (for example, verge, footway or carriageway), more than one application maybe required if the works are on multiple Unique Street Registered Names (USRNs).
