Section 31(6) of the Highways Act 1980 allows the owner of a piece of land to lodge a highways declaration and a highways statement with the council that they have no intention of dedicating any further Public Right of Way (PRoW) over their land.
This process does not affect any PRoW that are already recorded on the definitive map and statement, but it does prevent the public from acquiring a new PRoW through long use.
Highways declarations and highways statements are public documents and the council is required to keep an up to date register of all the declarations and statements we have received.
