Public Space Protection Orders

The Groves and Union Terrace PSPO - 25 July 2022

The Anti-Social Behaviour, Crime and Policing Act 2014 introduced new powers, including a Public Spaces Protection Order (PSPO), which is granted by the local authority, but can be enforced by either the local authority or the police.

A PSPO will allow the police and the council to stop individuals or groups from carrying out acts of anti-social behaviour.

The Groves and Union Terrace Public Spaces Protection Order - 25 July 2022

This Order is made by The Council of the City of York ("The Council") under the Anti-Social Behaviour, Crime and Policing Act 2014, Section 59 ("the Act").

  • 1. This Order relates to the area described in Paragraph 1 of The Schedule below and defined by the Groves PSPO area set out on the PSPO area map ("the restricted area"), being a public place in the Council's area to which the Act applies.
  • 2. The Council is satisfied that the 2 conditions below have been met, in that:
    • a) activities carried on in the restricted area as described below, have had a detrimental effect on the quality of life of those in the locality, or it is likely that these activities will be carried on in the public place and that they will have such an effect. The said activities being the consumption of alcohol and anti-social behaviour (ASB) associated with the consumption of alcohol, taking place in the public place. The ability to remove large groups of 3 or more people who are causing ASB.
    • b) that the effect, or likely effect of the activities described above, is, or is likely to be, of a persistent or continuing nature, is, or is likely to be, such as to make the activities unreasonable, and justifies the restrictions imposed by the Order.

By this order

  • 3. The effect of the Order is to impose the following prohibitions at all times:
    • a) In the restricted area, the Groves PSPO area set out on the PSPO area map, any person who continues to consume alcohol when asked not to consume alcohol commits an offence.
    • b) In the restricted area, the Groves PSPO area set out on the PSPO area map, any person who fails to surrender any alcohol in their possession when asked to do so by a constable or an authorised person, commits an offence.
    • c) In the restricted area, the Groves PSPO area set out on the PSPO area map, any groups of 3 or more persons who are causing ASB within the area commits an offence
  • 4. The Order will remain in force for a period of 3 years from the date of this Order, 25 July 2022, unless extended by further Orders under the Council's statutory powers.
  • 5. In this area any person who fails to comply with condition 3 above commits an offence and is liable on summary conviction to a fine not exceeding level 2 on the standard scale or a fixed penalty notice of £100, reduced to £75 for payment within the first 14 days.

The Schedule

  • 1. The Restricted area is described as the area bounded by Bootham, Gillygate, Lord Mayor's Walk, Monkgate, the River Foss, Hambleton Terrace, Field View, Filey Terrace, Scarborough Terrace and Grosvenor Terrace, and is shown as the Groves PSPO area set out on the PSPO area map.
