If you want to place tables and chairs outside your premises on the highway you will need:

  • planning permission
  • a Highway Licence (pavement café licence)
  • public liability insurance to £5m

Planning permission must be in place before you apply for your pavement café licence.

Please read the pavement café standard conditions before making your application.

New pavement café licence

Once planning permission is obtained you will need to:

Note that:

  • the Highway Licence is a legal document
  • it can take several weeks for us to process your application

You'll be issued with a temporary licence until your application is approved.

Renewal of pavement café licence

You will need to renew your licence every year.

Apply in plenty of time as the process can take up to 6 weeks. We will send you a reminder approximately 6 weeks before your current licence expires.

Tacit consent

Not all applications fall under tacit consent parameters, due to reasons of public interest.

If tacit consent applies, then you can act as if your application has been granted if we do not respond within a specified time after the confirmed receipt of your application.

Tacit consent does not apply to this application, therefore it is in the public interest that we process your application before it can be granted.

  • you cannot assume permission will be given
  • we will contact you within 21 days to acknowledge receipt of your application
  • if you have not heard from us within 21 days please contact us to check the status of your application
