“TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015, AS AMENDED (“THE ORDER”)
NOTICE OF DIRECTION MADE UNDER ARTICLE 4(1) TO WHICH ARTICLE 6 APPLIES
The Council of the City of York (“The Council”) made an immediate Article 4 Direction on the 3rd March 2017, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015, (as amended). Under the legislation, an Article 4 Direction shall expire at the end of six months from the date on which it was made unless confirmed by the Council before the end of the six month period.
Representations can be made to the Council in relation to the Direction from 13th March 2017. The closing date for representations to be made is by 4pm on 21st April 2017.
The Article 4 Direction applies to land at 79 Fulford Road York as shown edged in red on the plan attached to the Direction.
The Direction relates to development consisting of:
Demolition of the building containing the Former Theatre Royal arches at the front of the land at 79 Fulford Road York which is registered at HM Land Registry as part of Title Number NYK49057 and is shown edged red on the plan attached to the Direction pursuant to Schedule 2 Part 11(Heritage and Demolition) Classes B and C of the Town and Country Planning (General Permitted Development) Order 2015 (as amended).
Development of the description set out above should not be carried out on the land shown edged in red on the plan annexed to the Direction, unless planning permission is granted on an application made under Part III of the Town & Country Planning Act 1990, as amended.“
