We (the council) hold the legal record of public rights of way. This is known as the Definitive Map and Statement and it is evidence in law of the public rights recorded on it.
The Definitive Map is the minimum record of public rights of way. There may also exist additional public rights of way which have not yet been recorded on the Definitive Map, or there may be rights which have been incorrectly recorded.
The Definitive Statement is a description of each of the routes recorded on the map and includes any restrictions to their use. Many of the statements for York are extremely brief.
The Definitive Map is a public document and you can see it at 9 St Leonard’s Place, 8.30 am to 5.00 pm, Monday to Friday. If you think the Definitive Map is incorrect you can apply to make a change to it. For example you may apply for:
However, since the Definitive Map is legally conclusive proof of the existence of the public rights of way shown on it you will need to supply strong evidence to support your claim. If you supply sufficient evidence we are obliged to make a legal order known as a Definitive Map Modification Order to make the change.
Public rights of way can only be diverted or extinguished by a legal order known as a Public Path Order. They can also be created in a similar way.
Landowners can apply for a diversion of a public right of way running across their land. In most cases they would be expected to meet the full costs of making the order. Occasionally we will make an order in the interests of public safety or to put right long standing problems. Members of the public can object to an order if they wish.
