Bus shelters warning

City of York Council is advising residents and visitors which bus shelters they will and won't be able to smoke in from 1 July.

The new national smokefree legislation will apply to approximately 50 per cent of bus shelters, in the city if they are classified by the National Health Service guidance as 'substantially enclosed' public places.

City of York Council has a duty to ensure that 'substantially enclosed' shelters are smokefree and is keen to make sure that people know which of the shelters they can and can't smoke in.

Dawn Clarkson, from the council's smokefree team, said: "The new legislation will only affect some of the city's bus shelters, because whether people can smoke in them or not depends on the size of the openings. To avoid any confusion we will be displaying notices in the shelters which are 'substantially enclosed' and classified as smoke free."

Examples of shelters in the city which will be smokefree are the shelters on Rougier Street in front of Norwich Union and opposite the Railway Station.

Anyone who smokes in a smokefree shelter may be issued a fixed penalty notice of £30 if paid within 15 days or £50 if paid between 15 - 29 days.
