05.07.02: Nuisance Tenant is Ordered Out

City of York Council has won another eviction order against a tenant in its continuing drive to clampdown on nuisance neighbours.

The council obtained a warrant of possession against Larry Edward Scott at York County Court today. Scott, 54, of Sirocco Court, Fossway, was taken to court by the council for breaching the terms of a possession order granted to the council at an earlier hearing in 2000.

Today's hearing was told that Scott had caused nuisance and annoyance to his neighbours with drunken and intimidating behaviour over a long period. He will now be evicted within the next few weeks at a date to be confirmed by the Court Bailiff.

In addition to the warrant of possession the council also obtained an injunction against Scott with the aim of preventing him causing nuisance and alarm or distress to his neighbours at Sirocco Court.

He was told that he will be brought back to court if he breaches the injunction. Once he has been evicted the injunction will bar him from coming within 50 metres of until January 5 next year.

District Judge Wildsmith accepted that City of York Council had issued clear warnings to Scott that he would be evicted if he continued with his drunken behaviour. While he also accepted that Scott had a drink problem District Judge Wildsmith agreed the council should be granted the warrant for possession.

Neil McFarlane, the council's tenancy enforcement manager, said, "We are delighted to have secured this order after today's very long hearing. City of York Council is determined to ensure that tenants can live peacefully wherever they are in the city.

"The council will not tolerate harassment and nuisance to tenants and we will continue to work with residents and other agencies to secure evictions if necessary."
