From the 6 April 2008, new procedures apply to requests made to the Council
to discharge conditions imposed on planning approvals, and to requests
seeking confirmation that conditions have been complied with.
Examples might include the submission of drainage details, or details of
proposed external materials, such as bricks and roof tiles.
- You should be aware that if development is commenced without compliance
with the terms of conditions having been met, the planning permission
itself maybe at risk of being nullified.
- We request forms are used for all such requests in the future to ensure
all necessary details are provided, and so requests can be dealt with
consistently. The form can be downloaded on the right. More detailed
standard forms are available on the Planning
Portal.
- The government has introduced a charge for such
requests, currently £85.00 per request, or £25.00 for
conditions relating to 'householder' applications. This fee must be
submitted at the same time the request is made.
- The council will try to handle requests speedily, however if a response
is not received within 12 weeks, the fee will be refunded.
- The fee is payable for each request, a single request may be for more
than one condition to be discharged.
- The fees do not apply to telecommunications development (under Part 24
of Schedule 2 of the Town and Country Planning (General Permitted
Development) Order 1995), and these arrangements to do not apply to
conditions on Waste and Minerals permissions, for which separate
arrangements already apply.
- Requests to confirm whether or not conditions have been discharged,
from Solicitors or prospective purchasers will be handled the same
way.
